Terms of Service
Last updated: October 1, 2026
These terms are an agreement between you and Data Atlas, operated from Newfoundland and Labrador, Canada. By using the website, the application or a form published through them, you agree to them. If you use Data Atlas on behalf of an organization, you confirm you can bind that organization, and "you" includes it.
1. Definitions
- Service: the Data Atlas website, application and API.
- Form: a form you build in the editor. Campaign: a published, pinned version of a form that collects submissions.
- Your content: forms, campaigns, documents, settings and anything else you or your members put into the Service.
- Submissions: what respondents enter into your campaigns, including uploaded files.
- Organization: the workspace that owns forms and holds a plan; owner and admin are the roles that can manage it.
2. Accounts
You can use the editor without an account; a draft then lives only in your browser. To save to an organization and publish campaigns you sign in with Google or GitHub. You are responsible for what happens under your account and for keeping your sign-in provider secure. You must be at least 16, and old enough to enter a contract where you live.
3. Your content and submissions
You own your content and your submissions. You give Data Atlas the permission it needs to store, display, process and transmit them to run the Service, including delivering submissions to destinations you configure and to the third-party providers named in the privacy policy. That permission ends when you delete the content or your account, except for copies in routine backups for a short period.
Between you and the people who answer your forms, you are responsible for the submissions: for having a lawful basis to collect them, for telling respondents what you will do with their answers, and for honouring their requests about their data. Data Atlas processes submissions only on your instructions. If you need a data processing agreement, write to us.
4. Acceptable use
You agree not to use the Service to:
- collect information unlawfully, or without the notice and consent the law requires;
- publish forms that deceive respondents about who is asking or why, or that impersonate another person or organization;
- collect passwords, payment card numbers, government identifiers or health information unless you have a lawful basis and appropriate safeguards;
- upload malware, or files you have no right to process;
- send unsolicited bulk messages, or use the Service to harass anyone;
- probe, overload or interfere with the Service, or access other users' data;
- resell the Service or remove notices from it.
We may remove content or suspend accounts that break these rules, and will tell you when we do unless the law prevents it.
5. Plans, payment and cancellation
The free plan includes a limited number of responses per organization per calendar month, stated on the pricing page. When the monthly allowance is used up, your forms stop accepting responses until the next month begins. The Team plan removes the limit for the whole organization and is billed as a recurring subscription. Purchases are made through Lemon Squeezy, our merchant of record, which charges you, issues the invoice and collects any applicable tax; its terms also apply to the purchase.
You can cancel from the organization's Billing tab or through the customer portal at any time. Cancellation takes effect at the end of the period already paid for; access continues until then and there is no refund for the remainder, except where the law requires one. If a payment fails, we will keep the plan active for a short grace period while Lemon Squeezy retries, then return the organization to the free plan. Prices may change with at least thirty days' notice; the new price applies from your next renewal.
6. Availability and changes
We work to keep the Service available and to back up its data, but we do not promise uninterrupted operation. We may change or discontinue features; if we discontinue a paid feature we will give reasonable notice and refund any prepaid amount for it. Some features are released gradually and may not be available to every organization.
7. Third-party services
Sign-in providers, Google Sheets, Lemon Squeezy and the other providers named in the privacy policy have their own terms. Connecting a Google account gives Data Atlas only the access you approve on Google's consent screen, and you can revoke it in the app or in your Google account settings.
8. Intellectual property
The Service, its design and its software belong to Data Atlas or its licensors. These terms do not give you any right to them beyond using the Service. Feedback you send us may be used to improve the Service without obligation to you.
9. Disclaimer
The Service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose. Automated features such as document extraction and classification can be wrong; you are responsible for reviewing their output before relying on it.
10. Limitation of liability
To the extent the law allows, Data Atlas is not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data, arising from the Service. Our total liability for any claim is limited to the amount your organization paid us in the twelve months before the claim, or one hundred Canadian dollars if you paid nothing. Nothing in these terms limits liability that cannot be limited by law.
11. Termination
You can stop using the Service and ask us to delete your account at any time. We may suspend or end your access if you break these terms or if we discontinue the Service, with notice where practical. On termination your organization's plan ends, and your content is deleted after a reasonable period during which you can export it. Sections that by their nature should survive, including 3, 8, 9, 10 and 12, do.
12. Governing law and disputes
These terms are governed by the laws of Newfoundland and Labrador and the federal laws of Canada that apply there. Disputes go to the courts of that province, unless the law where you live gives you the right to bring them elsewhere. Before either of us goes to court, we agree to try to resolve the matter by writing to each other.
13. Changes to these terms
We may update these terms. We will post the new version here with its date, and for material changes we will tell signed-in users in the app at least fourteen days before they take effect. Continuing to use the Service after that means you accept them.
